SF City Sued Again -Illegally Overcharging Indigent Patients For Health Care...

So, here we are, again . . . First, it was the City of Fresno - sued for violating The Constitutional Rights of its residents, whose property was taken, destroyed and bulldozed, by heartless Fresno City Workers. The High Court ruled in favor, of The People harmed by bad City policies and illegal city employee conduct, and ordered the City of Fresno to pay a couple million dollars in damages. Their Mayor humbled himself and publicly apologized for 40 years of mistreatment. Mayor Autry of Fresno, did wrong in his policies and harmed a lot of innocent people in need. But, he had the GUTS, after reading the personal stories of people who's life possessions were ripped away from them by city workers, to APOLOGIZE and admit they were doing it all wrong by 'manhandling' people who are weak and vulnerable. We have TOTAL RESPECT FOR MAYOR AUTRY. HE IS AN EXAMPLE THAT ALL MAYORS AND GOVERNORS SHOULD FOLLOW. He is a Man. Who can admit, when he and his City's policies are wrong. Maybe he can be Our Next Governor.... at least we'd have a man in Sacramento who has already made the transition from hater and abuser (in affect) to humble and compassionate leader. . Then The City of San Francisco was sued for alleged violations of the ADA (Americans With Disabilities Act) because of their mistreatement. We are lining up more action to hold this City's Officials and employees and officers who violate our rights or given safe passage or haven to KNOWN violent offenders and drug dealers, so we can make sure WE ARE ALL SAFE. SOURCE: http://www.bluoz.com/blog/index.php?/archives/558-Corea-vs-City-and-County-of-San-Francisco.html As we have seen lately, we have had all kinds of city workers and non-profit workers in this City, sometimes blatantly abuse and cause harm to our people in need, to the point where their wreckless bad behavior mixed with lack of enforcement and oversight, is now shown to causing great harm AND DEATH to people, who would not have died or suffered, if we had solid leadership and a common sense of integrity and compassion inside of city's departments, agencies and non-profits... But, instead we're going to see more and more of these suits as our people increase the number of cases documented and prosecuted, until we have CLEANED OUT these messed up and criminal minded and neglectful public servants, so we can all BE SAFE and PROSPER TOGETHER without fear of being beaten, abused or neglected by people we pay who cannot be trusted. Replace them all with our own good and trusted people, whom have proven track records of heart, compassion, experience and common sense and RESPECT for ALL OF OUR PEOPLE and OUR LAWS AND CONSTITUTIONS. Email us today, with your tips, photos and stories of How You Are Treated By Our City Workers, Agencies and Service Providers, so we can work together to clean this mess up, ourselves, since we seem to be all that we have. At least we are here for each other and we will overcome these corrupted systems for the benefit of our entire community. SFHomeless Yahoo! Group Moderator

A lawsuit filed December 30, 2008 alleges that the City and County of San Francisco has been illegally overcharging indigent patients for needed health care

Plaintiffs allege that poor and indigent patients are being overcharged for care, including under the city's universal access program.

Mayor Gavin Newsom made headlines in 2006 with Healthy San Francisco (PDF)

Mayor Gavin Newsom called the health care plan "a real solution to our health care crisis."
The mayor said,
"This program ensures that San Franciscans who can't afford insurance can finally afford health care. By guaranteeing access, primary care and prevention, we will dramatically improve the health of all San Franciscans."
The mayor continued saying,
"This plan represents an order of magnitude change in our approach to providing health care."

This lawsuit has NOT been reported widely in the San Francisco press except for the legal newspaper, the Recorder.
The initial complaint itself is also unavailable as it has not yet been posted by the Superior Court.
The City of San Francisco has not yet responded to the complaint and it might tale quite a while for this to be resolved

I have obtained a PDF of the initial complaint and you can download it here > corea.v.ccsf.pdf

corea1 (by auweia)
In related news, just 4 days ago, from The New Republic

A little-noticed court ruling on Monday may actually be the San Francisco earthquake in the health reform debate that sends aftershocks felt around the country.

The full Ninth Circuit Court of Appeals upheld the San Francisco Health Care Security Ordinance, setting up a possible Supreme Court challenge about the city's attempt at providing universal access to care -- a possible model for the nation and many other states and counties.

Sponsored by then-Supervisor Tom Ammiano and signed into law by Mayor Gavin Newsom, Healthy San Francisco focuses on providing a new, affordable public option for both employers and individuals, based on a sliding scale. Those employers who provide private coverage now don't have to do anything more, but those that don't (with 20 or more workers) are required to pay a per hour, per worker fee -- which gets their workers the public plan. Individuals can buy-in, up to five times the federal poverty level, regardless of pre-existing conditions. The new funds go to bolster the network of public providers that everybody relies on, and help those who need subsidy.

MODERATOR NOTE:

This BLUOZ Blog is home to one of many PRIVATELY OWNED video cameras posted in public and common places, so we can SEE and RECORD the violence and mayhem inside our City Master Leased SRO Hotel Rooms, where our tax dollars go to put our own people, into places that often get more 9-1-1 calls than our tax funded shelters (where calling the police is frowned upon...

And DISCOURAGED to keep quiet, how dangerous these places are because of LACK of proper funding, planning and enforcement of our laws and Constitutions and Human Rights by contracted non-profits and local agencies).

WE NEED MORE VIDEOS INSIDE MORE SRO HOTELS TO KEEP US ALL SAFE FROM THE THUGS, BEATERS AND HATERS THERE.

500 SRO Hotels with as many as 30,000 people, at risk, every day.

Comfortable Ranch Home Today. Homeless Shelter Mat Tomorrow - 30,000 New Home-less In Iowa

This is a message for the individuals who look down upon or think they are superior to 'our nation's homeless residents'. Or even those individuals ignore, neglect, hate or refuse to help another home-less human being in their own home towns. Who Are Today's Home-Less In America ? Home-less in San Francisco ? Our 'home-less' communities everywhere are made up of all kinds of people. They actually mirror our 'non-homeless' communities, more often than not. [ NOTE: General estimates provided below are general percentages based on a variety of sources which cannot agree on exact numbers. Some sources are like US Census numbers, City homeless counts, community advocacy groups, veterans groups, et al.) ] Some 24% are War Veterans. About 20% are elderly with no place to go because living expenses (artificially high rents, mortgages and lack of rent control) overtook their fixed income and medical costs (also artificially jacked up). Another 30% are drug addicts or alcoholics who finally hit rock bottom, lost their jobs and homes. Another 25%-50% are under age minors who are not at fault to what may have caused their family to become home-less. Another high percentage are women, disabled and victims of crimes who had to 'flee' their homes to save their lives and the lives of their children. A much smaller but growing segment of our nation's home-less are people like The Katrina Victims, who were scattered all over the country after losing their homes where some had lived for all or most of their lives. Now, we can unfortunately add another 30,000+ innocent people who were forced out of their 'stable homes' due to the natural disaster of flooding in the state of Iowa. Thousands more are becoming home-less as we all suffer more natural disasters and the faults of our government who have NOT done a great job of timely planning and financing to replace thousands of aging dams, dikes, levees and other structures around the country. ANY ONE OF US CAN BECOME HOME-LESS AT ANY TIME. SO, IF YOU ARE NOT HOME-LESS - ARE YOU SUPERIOR TO US ? OR ARE YOU JUST PLAIN LUCKY, FOR NOW.
Do what you can to help your community now, with understanding and kindness because any day now, YOU may be the next guest of a local homeless shelter or soup kitchen or local park, IF YOUR CITY FAILS TO BUILD ENOUGH SAFE SHELTERS & HOUSING PROGRAMS FOR YOU - AND YOUR FAMILY IN YOUR TIME OF NEED FOR COMMUNITY SUPPORT. SAN FRANCISCO EASILY HAS BETWEEN 10,000 AND 25,000 PEOPLE HOME-LESS AT ANY TIME. City Officials and Federal Officials and even the mainstream media use what we call 'fake definitions' of who are 'the home-less', but we, the people who are home-less use a much more realistic and accurate definition. After all, who can better define what an artist is than an artist themselves. Same thing for those of us who are home-less. Our own self-definition is much more valid than that 'fake label' affixed to us by people who have never been home-less. [ We consider the 30,000 residents living in our City's 500 SRO's (Single Room Occupant Units) to be 'home-less' because many are required to waive their rights to Tenancy, which means they can be tossed out into the streets again, because they have no rights as the people who are Not Home-Less. A budget cut or staffing cut could cause them to become instantly home-less because they have no control or say-so abou the place where they are being 'housed'. Being housed in a place you have no control or rights to true residency means you are still home-less.] OUR SHELTER CAPACITY WAS ABOUT 1,200 BEDS AND FLOOR MATS LAST YEAR BUT IS CONSTANTLY AND METHODICALLY BEING REDUCED BY OUR CITY OFFICIALS - PLACING MORE AND MORE SAN FRANCISCANS AT RISK, EVERY DAY. THIS PRACTICE IS COSTING US ABOUT FIVE TO TEN TIMES AS MUCH MONEY IN PREDICTABLE AND PREVENTABLE EMERGENCY RESPONSE, CARE AND CRISIS INTERVENTION THAT COULD HAVE BEEN PREVENTED IF WE BROUGHT ALL OF OUR SHELTER, DROP IN CENTER AND HOUSING STOCK UP TO MEET A CAPACITY LEVEL THAT CAN MEET REAL CURRENT AND FUTURE NEEDS. RAISING STOCK OF SAFE PLACES SAVES LIVES AND SAVES US ALL LOTS OF TAX PAYER MONEY. EVERYTIME WE LIFT UP OUR OWN HOME-LESS, MANY OF THEM BECOME PRODUCTIVE, GET JOBS, PAY SALARY TAXES AND CONTRIBUTE BACK TO OUR OWN COMMUNITY. IT MAKES SENSE TO PREVENT HARM AND ITS CHEAPER THAN WHAT WE ARE DOING NOW. ASK OUR HERO MAYOR AUTRY OF FRESNO WHAT HE THINKS. HE'LL TELL YOU THEY WERE DOING IT ALL WRONG FOR SOME 20 TO 40 YEARS. AND THEY NOW APPEAR TO BE TAKING THE LEAD ON 'DOING RIGHT' BY THEIR HOME-LESS. YOUR OWN CITY NEEDS TO CONSIDER FOLLOWING THEIR COURAGEOUS AND MONEY SAVING-LIFE SAVING LEAD BEFORE YOU AND YOUR FAMILY BECOME HOME-LESS.

Midwest flood woes head south

Iowa has shed much of the water that plagued it. Now the misery moves down the Mississippi River, threatening new towns.

By P.J. Huffstutter, Los Angeles Times Staff Writer -- June 18, 2008

IOWA CITY, IOWA -- With floodwaters receding in much of Iowa, the destruction moved downstream Tuesday as emergency crews and residents raced to bolster the levees that protect dozens of Mississippi River towns.

The storms have hit Iowa especially hard. Gov. Chet Culver has declared 83 of the state's 99 counties disaster areas. An estimated 38,000 people are homeless.

State officials gauge the damage to Iowa's corn crop alone at more than $2.7 billion, with the cost of repairing and rebuilding Cedar Rapids -- the state's second-largest city -- expected to be at least $1 billion.

1st US Mayor, HUD Official, Federal Judge 'Get' Social Justice for Suffering Residents

This is a profound moment in U.S & World History demonstrating that every person with or without money, home or wealth are entitled to Equal Protection, under our Federal and State Constitutions. In Fresno, California in 2008, we have a duly elected Mayor Autry and a US District Court Judge Wanger who saw fit to right a series of wrongdoings by City Workers involving the raids and taking of property where people with nowhere safe to go were attempting to just live, be and to be left alone. All people, regardless of if they have a job or money now, last week, last month or last year have inalienable rights to life (liberty and pursuit of happiness) and other constitutional protections. To live safely somewhere even if they have no money or great material wealth. To any person, agency or groups to be told or actually do mistreat any other person, home-less or not, or take their personal property without due process is guilty of great moral and legal offenses demanding justice, compensation & remedy to protect us all.
ACLU of Northern California

Kincaid v. Fresno

June 6, 2008
A U.S. district judge gave preliminary approval June 6 to a $2.35 million class-action settlement between a class of hundreds of homeless Fresno residents and the City of Fresno and the California Department of Transportation. The court had already determined that Fresno’s practice of immediately seizing and destroying the personal possessions of homeless residents was unconstitutional. Funds from the settlement will go to individual plaintiffs whose belongings were destroyed in the illegal sweeps, as well as into an account to provide housing and medical care to the approximately 225 class members.
During oral argument on April 25, 2008, Judge Oliver W. Wanger of U.S. District Court of the Eastern District of California declared that “the practice of announce, strike, seize [and] destroy immediately is against the law.”
Personal property, including essential medications, family photographs, and vital documents had been confiscated by police and city workers.
