On Friday, March 13th, 2009, at around 6:50 PM, more than a dozen local residents and tourists saw a horrific beating of local resident, by two large, burly men who own or work at a nearby Smoke Shop.
Witnesses saw the New Owners/Worker of the Polk Street Smoke Shop (located between Kimos and Chai-Yo Restaurant, across the street from H20 Cafe and the Funky Door Yoga and Polk Street Produce Store) chase a 140 lb. gay transgender resident out of their store, after the resident tried to get a pack of matches to light a cigarette with.
The victim may or may not have even grabbed a lighter to light their cigarette with because the Smoke Shop Owners were mean and wanted to charge the victim $1.50 for a lighter they sell normally for a buck....
The two men from the Smoke Shop, were seen 'jumping' the victim from behind, punching and kicking him as he tried to flee from the confrontation.
This victim was beaten down directly in front of the Chai-Yo Thai Noodle Restaurant at the corner of the 1300 block of Polk Street and Frank Norris Alley.
After this victim was beaten down to the ground, the two men, both weighing between 175 and 210 lbs each, punched and kicked the victim, while laying on the ground trying to protect their face and vital parts.
The two beaters shouted F***GOT and B**TCH as they beat on the victim.
This was a felonious Hate Crime against one of our own local residents, who is not known to cause any harm or violence to others.
We're not going to get into the details about how the SFPD Officers responded and what their conduct and behavior looked like because that is a matter currently under investigation by other authorities.
IF YOU OR ANYONE YOU KNOW WITNESSES THIS HORRIBLE HATE CRIME OR IF YOU HAVE HAD EXPERIENCE WITH THESE NEW OWNERS OF THE POLK STREET SMOKE SHOP (according to city records, the old owners that we all liked sold this business to these new guys last month in February 2009), YOU ARE URGED TO SEND US AN EMAIL, AS SOON AS POSSIBLE.
IF YOU HAPPENED TO TAKE ANY PHOTOS OF THE BEATING OR THE OFFICERS INVOLVED, WE WILL BE HAPPY TO ACCEPT THOSE AS WELL.
ALL THIS INFORMATION WILL BE FORWARDED DIRECTLY TO LOCAL, STATE AND FEDERAL LAW ENFORCEMENT AGENCIES AND PROSECTORS, AS WELL AS MODIFIED COPIES (WITH THE WITNESS NAMES REMOVED) OF YOUR REPORTS WILL BE SENT TO VARIOUS CIVIL RIGHTS, SOCIAL JUSTICE AND HUMAN RIGHTS AGENCIES AND COMMISSIONS FOR THEIR RECORDS.
As a courtesy, a copy will also be sent to SF Mayor Newsom's Offices and the SF Human Rights Commission.
Thank you for helping us to keep us all safe from any resident who poses a threat to our good people and to keep us safe from bad local officers who REFUSE to follow the law and arrest violent, out of control people or that REFUSE to interview witnesses who are eager and ready to attest to what they saw that day.

SF City Sued Again -Illegally Overcharging Indigent Patients For Health Care...
So, here we are, again . . .
First, it was the City of Fresno - sued for violating The Constitutional Rights of its residents, whose property was taken, destroyed and bulldozed, by heartless Fresno City Workers.
The High Court ruled in favor, of The People harmed by bad City policies and illegal city employee conduct, and ordered the City of Fresno to pay a couple million dollars in damages. Their Mayor humbled himself and publicly apologized for 40 years of mistreatment.
Mayor Autry of Fresno, did wrong in his policies and harmed a lot of innocent people in need.
But, he had the GUTS, after reading the personal stories of people who's life possessions were ripped away from them by city workers, to APOLOGIZE and admit they were doing it all wrong by 'manhandling' people who are weak and vulnerable.
We have TOTAL RESPECT FOR MAYOR AUTRY. HE IS AN EXAMPLE THAT ALL MAYORS AND GOVERNORS SHOULD FOLLOW.
He is a Man. Who can admit, when he and his City's policies are wrong. Maybe he can be Our Next Governor.... at least we'd have a man in Sacramento who has already made the transition from hater and abuser (in affect) to humble and compassionate leader.

Then The City of San Francisco was sued for alleged violations of the ADA (Americans With Disabilities Act) because of their mistreatement.
We are lining up more action to hold this City's Officials and employees and officers who violate our rights or given safe passage or haven to KNOWN violent offenders and drug dealers, so we can make sure WE ARE ALL SAFE.

As we have seen lately, we have had all kinds of city workers and non-profit workers in this City, sometimes blatantly abuse and cause harm to our people in need, to the point where their wreckless bad behavior mixed with lack of enforcement and oversight, is now shown to causing great harm AND DEATH to people, who would not have died or suffered, if we had solid leadership and a common sense of integrity and compassion inside of city's departments, agencies and non-profits...
But, instead we're going to see more and more of these suits as our people increase the number of cases documented and prosecuted, until we have CLEANED OUT these messed up and criminal minded and neglectful public servants, so we can all BE SAFE and PROSPER TOGETHER without fear of being beaten, abused or neglected by people we pay who cannot be trusted.
Replace them all with our own good and trusted people, whom have proven track records of heart, compassion, experience and common sense and RESPECT for ALL OF OUR PEOPLE and OUR LAWS AND CONSTITUTIONS.
Email us today, with your tips, photos and stories of How You Are Treated By Our City Workers, Agencies and Service Providers, so we can work together to clean this mess up, ourselves, since we seem to be all that we have.
At least we are here for each other and we will overcome these corrupted systems for the benefit of our entire community.

A lawsuit filed December 30, 2008 alleges that the City and County of San Francisco has been illegally overcharging indigent patients for needed health care
Plaintiffs allege that poor and indigent patients are being overcharged for care, including under the city's universal access program.
Mayor Gavin Newsom made headlines in 2006 with Healthy San Francisco (PDF)
Mayor Gavin Newsom called the health care plan "a real solution to our health care crisis."
The mayor said,
"This program ensures that San Franciscans who can't afford insurance can finally afford health care. By guaranteeing access, primary care and prevention, we will dramatically improve the health of all San Franciscans."
The mayor continued saying,
"This plan represents an order of magnitude change in our approach to providing health care."
This lawsuit has NOT been reported widely in the San Francisco press except for the legal newspaper, the Recorder.
The initial complaint itself is also unavailable as it has not yet been posted by the Superior Court.
The City of San Francisco has not yet responded to the complaint and it might tale quite a while for this to be resolved

A little-noticed court ruling on Monday may actually be the San Francisco earthquake in the health reform debate that sends aftershocks felt around the country.
The full Ninth Circuit Court of Appeals upheld the San Francisco Health Care Security Ordinance, setting up a possible Supreme Court challenge about the city's attempt at providing universal access to care -- a possible model for the nation and many other states and counties.
Sponsored by then-Supervisor Tom Ammiano and signed into law by Mayor Gavin Newsom, Healthy San Francisco focuses on providing a new, affordable public option for both employers and individuals, based on a sliding scale.
Those employers who provide private coverage now don't have to do anything more, but those that don't (with 20 or more workers) are required to pay a per hour, per worker fee -- which gets their workers the public plan. Individuals can buy-in, up to five times the federal poverty level, regardless of pre-existing conditions.
The new funds go to bolster the network of public providers that everybody relies on, and help those who need subsidy.
